1. Company Information

1.1 Bargain Tools is owned by Express Cutting & Welding Services Ltd. and is run as a division of this firm. Express Cutting & Welding Services Ltd. is a leading supplier of Welding Equipment and Safety Supplies to the Central Lancashire area of England and been established for over twenty years.

1.2 Express Cutting & Welding Services trades from 245 Walton Summit Centre, Oldfield Road , Bamber Bridge , Preston , PR5 8BG and has been trading from this address since 1991.

2. Our Contract

2.1 These Terms and Conditions govern the supply of goods between Express Cutting & Welding Services Ltd. (referred to as "us" in this document), and the customer, as named during registration and repeated on the order form (referred to as "you").

2.2 The terms and conditions within this document, combined with your order form, constitute the only agreement between yourself and us for the delivery of goods as entered on to the online order form. Upon acceptance of your order, which is confirmed by the delivery of goods, a legally binding agreement is constituted based upon these terms and conditions.

3. Price and Payment

3.1 We have taken the utmost care to ensure that all prices displayed on the website are correct, including charges for carriage. Any errors with regards to prices are purely accidental and we reserve the right to correct these as may be necessary.

3.2 Goods will only be supplied after payment has been made in full. No order will be delivered where payment has only been made in part, unless otherwise agreed.

4. Delivery of Goods

4.1 Unless you inform us that you wish to collect the goods from our premises, they will be delivered in accordance with your order and a valid signature will be required at the point of delivery or collection. Immediately before dispatch of the goods, ownership of these goods is transferred to you. If within 21 days of the delivery date you have not received delivery of the goods then you must notify us immediately.

5. Availability & Substitution

5.1 We aim to hold as many items as possible in stock so that we may dispatch goods immediately, in response to an order. If any item ordered is out of stock, and we are unable to immediately acquire these items, then we will contact you to advise you of this, and to make alternative arrangements.

5.2 Occasionally certain manufacturers change product specifications in order to make improvements, and on rare occasions they even change product numbers to show this. Whilst we strive to keep our website up-to-date, there may be instances where we decide to send you a slightly different product than the one which you ordered. We reserve the right to do this, and we make the assurance that the substitution will be equal to or better in specification, and that it will always be from the same manufacturer.

6. Cancellation

6.1 You are allowed to cancel your order with us within 30 days of either collection or delivery of the goods. This may either be for part of the order or for the entire order. You can do this by contacting us either by telephone, fax, email or in writing, to any contact number or address on the website.

6.2 Upon cancellation, you must return the goods to us. If you are returning the goods to us because they are incorrect or faulty, we will pay the cost of return carriage provided that you make contact with us so that we know to expect their arrival and so that we may nominate the carrier for their return. If you do not permit us to nominate the carrier, then we reserve the right not to refund the full cost of return carriage.

7. Liability

7.1 We will always strive to ensure that deliveries made to customers are complete and correct. In the exceptional cases whereby incorrect, defective or damaged goods are delivered, we always endeavor to make amends with the customer. However, we will not take responsibility or liability for the effects on you or your business for failing to supply goods, or supply of defective, damaged, or incorrect goods. For example, these effects could include administrative inconvenience or loss of profits.

8. Termination & Cancellation

8.1 Whilst we aspire to supply all goods displayed on our website to any customer placing an order, there may be instances where we are unable, or unwilling, to take an order and we will notify such customers either by email, telephone, fax or in writing.

8.2 We also reserve the right to cancel any order at any time before delivery or collection, and where payment has already been made, we will refund this as appropriate.

9. VAT

9.1 All prices shown include VAT at the current rate of 20%, subject to changes in taxation. Express Cutting & Welding Services Ltd. is a VAT registered company and our VAT No. is 323 1936 76.

10. Age Requirements for Specific Goods

10.1 Where the law requires a minimum age limit for the purchase of specific goods, the person who receives the order may be required to confirm that they are of the required legal age to receive such items. For instance, bladed tools such as pocket knives which cannot be sold to persons under 16 years of age will not be delivered to any address where the person taking delivery appears under this age and cannot provide valid identification to the contrary.

11. General

11.1 If any part of these terms and conditions is deemed invalid, illegal or unenforceable, then this contract shall be interpreted in accordance with English Law. We aim for the contract to provide protection for both ourselves and our customers and it does not affect your statutory rights.
